David Uthman is a very experienced and successful criminal, DMV and traffic defense lawyer. He has over 20 years of experience as a litigation attorney and almost a decade of experience as a police officer. He is the managing attorney for the San Francisco Traffic Law Clinic, which successfully litigates thousands of traffic tickets every year and handles more cases in San Francisco Superior Court than any other law office.
Mr. Uthman works hard to uncover all potential defenses in your case and will thoroughly prepare you for your hearings or trial. He has a team of highly skilled assistants that work full-time in his office. He has a team of expert witnesses and private investigators, many whom also share significant law enforcement backgrounds. Using his team he has had many serious cases dismissed or had charges significantly reduced. Many of Mr. Uthman‘s clients are not United States citizens. He will take the time to understand their immigration status and work with them and their Immigration attorney’s to try and minimize any immigration consequences.
Mr. Uthman is a 2017 National Trails Lawyers, Top 100 Criminal Defense Lawyer; the American Institute of Criminal Law Attorneys, 2017 Top 10 Best Criminal Defense Attorney for Exceptional and Outstanding Client Service; he is a Santa Clara University School of Law Public Interest Law Scholar; he holds an Advance Certificate from the California Peace Officers Standards and Training agency (POST) and a Certificate of Appreciation from the San Francisco Police Department for his work counseling disadvantaged youth.
In the last year Mr. Uthman had a serious domestic violence case dismissed at trial, after his investigation showed that the alleged victim was untruthful and exposing inaccuracies in the police investigation. He had a third offense DUI case, where his client was facing a significant jail sentence, reduced to a “wet reckless“ after showing the District Attorney that their police investigation had serious flaws. In between handling these more serious cases, he prepared many clients who were facing DMV negligent operator (or similar) actions, to avoid license suspensions, or successfully convinced the DMV to return their suspended licenses. He helped numerous clients to mitigate their DUI and other criminal cases, so that they faced minimal consequences and disruptions to their lives.
Mr. Uthman has successfully handled very serious criminal cases, including vehicular manslaughter, felony DUI and domestic violence and other assault charges. Very recently Mr. Uthman has assisted a client to remove a “felony strike” from his record and have his felony DUI reduced to a misdemeanor. Mr. Uthman defended a client charged with vehicular manslaughter and felony DUI, getting all charges dismissed based upon the government’s violation of his client’s constitutional right to a speedy trial. He received a not guilty verdict for a client who was charged with assault with a deadly weapon on a highway patrol officer. In that case his client was accused of deliberately running over a CHP Officer. Mr. Uthman used a retired CHP accident reconstruction expert to expose serious flaws in the investigation and procedures used by the arresting officers. He helped a client charged with a felony DUI to get his case dismissed on the first day of trial, based in part by exposing discovery violations by the District Attorney. Over half of all Mr. Uthman’s jury trials resulted in either not guilty verdicts or mis-trials.
Prior to practicing law, Mr. Uthman work for almost one decade in California law enforcement as a police officer and deputy sheriff. The majority of that time was with the Santa Cruz County Sheriff’s Office. He was twice named “Deputy of the Month,” for doing an exemplary investigation at a homicide crime scene and for his investigation and arrest of a serial burglar. His assignments included working as a field training officer (FTO), SWAT team member, (scuba) Dive team member and working as a court bailiff. As a Watsonville police officer Mr. Uthman walked a foot be in a notoriously high crime downtown area. He made hundreds of drug arrests, which resulted in him being declared an expert witness in court. He honorably retired from law enforcement with a California Peace officer standards and training advanced certificate in order to attend law school full-time.
